Embezzlement trial could go to jury

QUITMAN The embezzlement trial of a former Clarke County Justice Court clerk could go to the jury sometime today.
Lynn Fagan of Quitman is charged with three counts of embezzlement. The prosecution contends that on three occasions during 1999, Fagan converted fine money she had received while working as an assistant Justice Court clerk for her personal use.
District Attorney Bilbo Mitchell said earlier this morning he planned to rest his case, and that the defense would begin its arguments.
Earl Smith of the state auditor's department has been a major witness for the prosecution. The state auditor's office had been called in by the Clarke County Board of Supervisors after money was reported missing. Smith was the chief investigator.
Fagan's former co-workers in the justice court office have also testified.
